The removal of this tax is one of the conditions
Judge Jackson's handed down in his findings.
Whilst it's not Law (yet) stateside, waving this at
the local Gateway people might be of some use. 
I also question the legality of M$'s tax in Oz,
I'd love to see a test case here, though I'm
no l'eagle.

For what it's worth, according to JJ's finding of
fact, Gateway have in fact been one of the OEM's 
who have fought quite hard against the M$ tax and
have been penalised by M$ for it.
