Not if he was simply asking. If he received a negative response (more than
likely) then he could have just not done it and this would never have
happened. He wouldn't have been failed for thinking about the idea. If he
was, then he'd have a much better case for appeal, since he would have
been failed on suspicion. AFAIK you can't be in the wrong for intent with
no action.
